Terms of Service
Please read these terms carefully before using our services.
Effective Date: 1 January 2025
Last Updated: 14 October 2026
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", "Reseller", or "LCO") and NACSS Internet Services ("NACSS", "we", "our", or "us"). By accessing our website, portal, or using any of our broadband or ISP management services, you agree to be bound by these Terms. If you do not agree, please discontinue use of our services.
1. Services Provided
NACSS provides the following services:
- High-speed broadband internet connectivity for residential and commercial subscribers.
- Enterprise leased lines and dedicated bandwidth solutions.
- ISP management portal for administrators, resellers, and LCOs — including customer management, billing, RADIUS integration, and network operations.
- Self-service customer portal for plan recharge, usage monitoring, and support.
- Partner programme for resellers and Local Cable Operators (LCOs).
We reserve the right to modify, suspend, or discontinue any service or feature at any time with reasonable prior notice.
2. Eligibility & Account Registration
- You must be at least 18 years of age to register for or use our services.
- You agree to provide accurate, current, and complete information during registration, including valid KYC documents as required under Indian telecom regulations.
- You are responsible for maintaining the confidentiality of your account credentials (username, password, internet password).
- You must notify us immediately at support@nacss.in if you suspect any unauthorised use of your account.
- One person or entity may not maintain more than one active account unless explicitly authorised as a reseller or LCO partner.
3. Billing & Payments
- Subscription fees are charged based on the plan selected and are due on or before the renewal date.
- All prices are inclusive of applicable GST unless stated otherwise. GST invoices will be provided upon request.
- Payments made through online gateways (Razorpay, PayTM, PhonePe, CCAvenue) are subject to those gateways' own terms and processing times.
- Successful payments activate or renew your plan on the same day. Failed payments do not result in service activation.
- Refunds are processed at our discretion. Service disruptions caused by infrastructure failures within our control may be eligible for a pro-rated credit.
- Resellers and LCOs may receive commissions based on the rates configured in their partner profile. Commission payouts are subject to a minimum wallet threshold.
4. Acceptable Use Policy
You agree not to use our services for any of the following:
- Any activity that violates Indian law, including the Information Technology Act 2000, Indian Penal Code, or TRAI regulations.
- Sending unsolicited bulk email (spam), distributing malware, or conducting phishing attacks.
- Unauthorised access to, or interference with, any computer system, network, or data (hacking).
- Hosting or transmitting content that is obscene, defamatory, or infringes any third-party intellectual property rights.
- Operating a public proxy, VPN exit node, or bandwidth resale service without prior written authorisation from NACSS.
- Any activity that consumes excessive bandwidth in a manner that degrades the network for other users (e.g., sustained peer-to-peer traffic above plan limits where Fair Usage Policy applies).
Violation of the Acceptable Use Policy may result in immediate suspension of your account without refund, and may be reported to relevant authorities.
5. Service Levels & Uptime
- We target a 99.9% monthly uptime SLA for our core network infrastructure.
- Scheduled maintenance will be communicated at least 24 hours in advance wherever possible.
- Last-mile connectivity speed may vary based on distance from the NAS, network congestion, and CPE hardware.
- We do not guarantee specific speeds for shared broadband plans. Speed tiers are "up to" values and represent maximum theoretical throughput.
6. Partner (Reseller & LCO) Terms
- Partners must obtain and maintain any licences required to operate as an ISP reseller or cable TV operator under applicable Indian law.
- Partners are responsible for the accurate management of their customers on the NACSS portal, including correct plan assignment and payment recording.
- Partners may not modify or misrepresent NACSS services, pricing, or branding without written approval.
- NACSS reserves the right to terminate a partner account for fraudulent activity, regulatory non-compliance, or violation of these Terms.
- Partner wallet balances that remain unused for 12 months after account termination may be forfeited.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- NACSS shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) our services.
- Our total aggregate liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.
- We are not liable for outages caused by force majeure events, actions of third-party network operators, government orders, or natural disasters.
8. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of courts in India. We encourage users to contact us first to resolve disputes amicably before initiating legal proceedings.
9. Termination
- You may terminate your account at any time by contacting our support team. Unused subscription days are non-refundable unless covered by a service failure.
- We may suspend or terminate your account immediately for violation of these Terms, non-payment of dues, or on receipt of a valid government or court order.
- Upon termination, your access to the portal and internet connectivity will cease. Certain data may be retained as required by law (see our Privacy Policy).
10. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or a notice in the portal. Continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use and contact us to close your account.
